I live in BC and am an "N" driver. About a month ago I got an excessive speeding ticket and was not pleased cause it was $370. I just opened my mail today and there was a letter from the government telling me that they intent to prohibit me from driving for 3 months unless I file a submission. If I do get prohibited, I cant get to work or school easily and will have my "N" untill for another 2 years.
They said that it was based on my bad driving record and I only have ever got 1 ticket.
Has anyone had any experience with this sort of thing and how to fight it?

see if you can go to traffic school or whatever to get points off your liscense. Thats how it works in the USA _________________ 1978 924 NA

Tom,
Truth be told, see a lawyer if you can afford it.
If you can't, go straight to the actual court in your area and speak to the Crown Council.
Tell them you'll agree to pay the fine if they drop the prohibition or you'll get a lawyer and fight it. They'd always rather settle out of court. Trust me..
I got away with Fake plates and an expired license once by pleading guilty to a lesser charge.
There are loopholes

tom, up here if you get 1 extreme ticket (excessive speeding, or driving with undo care) you will loose your license and start over.
For this very reason I recommend that you get your full license right away.
As to the submission, go to a laywer and ask for their opinion, and how much they would charge to write up a letter. _________________ 3 928s, |

I can't fight the ticket because I got it two months ago and paid for it. I was alright with paying the fine and I also got the ticket 4 hours away from where I live so fighting it would have been a pain and costed lots in gas and time.
This prohibition caught me way off guard and I wish that I had known that I was going to get it because if I did, i surely would have fought the ticket.
On the prohibition notice, it gives me the option to 'make a submission requesting a review of the decision to prohibit' which involves me writing a letter explaining why the prohibition should not be imposed.
This letter is my only way around the prohibition and I am in the middle of writing it. Do you guys have any suggestions of things that would be vital to include in my letter?
Also im a year away from my full license - is there any way of postponing it for that long?

First tip would be, learn the rules better, that way you can better understand the penalties involved with breaking them. Best way to deal with this is, don't speed, don't break the rules. And get your full license as quickly as you can. Your going to be severely inconvenience because of this, but your going to be prohibited. By paying the ticket, you admitted guilt, and from there, you lose your license based on the rules of the "N" system
I've had my "N" for 9 years (just haven't gotten around to getting my full license) I've managed to somehow not get my license prohibited in that time, it was simple, I obeyed the laws of the road.

Thank ICBC for those laws. Since I came to BC, I have learned to regret EVERY day being here. If the cost of living doesn't kill you, ICBC will.
How does the government get by with running a monopoly like this?? They make all the rules to jack rates and suspend driving for nearly any infraction.

It's common practice in Estonia also that if you get a driving prohibition during your first two years of licence, you will get beginners licence again as you don't drive full two years as a novice. And that can go on and on and on... _________________ '83 924 2.6 16v Turbo, 470hp

rule # 1 never admit guilt
rule # 2 Always try and negotiate the fines and penalties
rule # 3 see rules #1 and #2...
beg for a review (or what ever the process is there)... youve already paid the ticket thereby admitting fault, which puts you at their mercy... _________________ Eric

OK I am not the best driver when it comes to following the rules. here we have a points system you get 12 in 3 years you lose 1 point for under 10 kms over the limit and 3 for over 10kms anything over 20kms (i think) and that is 12 points in one hit. I once lost 21 points in a day in a work car... I had to drive a lot for work and went past the same fixed camera on the ring road 7 times each time over 10kms over the limit, try explaining that one to your boss. I leant that you need to follow the speed limit and even then that dosent always work as we have stupid rules and I lost 3 points for not wearing my seatbelt when I was caught pulling out of a service station putting it on, and 3 for going through a red light (which was only just red and had another red 20m in front of it so it didnt advantage me any) when a truck had locked up his brakes behind me and I made a decision that it was better to go through than get hit up the ass by a 20 tonne truck and all the police man could say was that if the truck hit me it was not my fault so I should have just stayed there well F*** you.
all this being said I have never lost my licence due to a really unusual fact about my existance, I have two birthdates, one on my citizenship papers and one on my birth cert. which effectively give me two identities due to someone entering 77 instead of 78 on one set of papers and given that I have legally changed my name on the first identity I have two names also (it wouldnt take much to work out the name change though)
here we also have an appeal system and if you can show that you are unfairly disadvantaged by the loss of you vehicle then you can get aroung the suspension sometimes. Three things that seem to work are, loosing your job if you cant drive, not being able to go to school without driving and if you can take public transport this dosent count, and three and this is the one I would push if you at all can, having a family member entirely dependant on you driving them to important places like doctors appointments, shops, hospital etc etc. besides this you can just beg and I dont think you have much of a shot if it is just inconvenient. _________________ 1977 924 2.0 Auto |
